Social Media Competition Terms and Conditions

Promoter

The promoter of all competitions is the Crystal Peaks Shopping Centre running the promotion (the “Promoter”).

Eligibility

Competitions are open to UK residents aged 18 years or over, unless otherwise stated in the individual competition rules.

Employees of the Promoter, its managing agents, contractors, retailers, agencies, and anyone professionally connected with the competition, including their immediate families, are not eligible to enter.

Only one entry per person is permitted per competition.

Entry into the competition is deemed as full acceptance of these Terms and Conditions.

How to Enter

Entry instructions will be clearly outlined in the relevant competition post. This may include actions such as liking, commenting, sharing, tagging, or submitting content. No purchase is necessary.

Entrants must ensure that any individuals tagged in an entry are willing participants in the competition.

Entries that are incomplete, false, deceptive, automated, generated by scripts or bots, or not submitted in accordance with the stated instructions may be deemed invalid.

The Promoter accepts no responsibility for entries not successfully completed due to technical faults, system errors, platform outages, or connectivity issues.

Competition Management

The Promoter reserves the right to modify, suspend, amend, or withdraw any competition at any time where reasonably necessary.

The closing date and any key dates will be specified in the relevant competition post. The Promoter reserves the right to amend competition end dates where circumstances outside of its control make this unavoidable.

Prizes

Prize details will be stated in the relevant competition post.

All prizes are non-transferable, non-exchangeable, and non-refundable. No cash or alternative prizes are available.

In the event of circumstances beyond the Promoter’s control, the Promoter reserves the right to substitute a prize with one of equal or greater value.

Winner Selection and Notification

Winner selection will be carried out fairly and at random, unless otherwise stated.

Winners will be notified by the Promoter or its representatives via social media direct message, email, or telephone, as appropriate to the competition.

Winners must respond within 7 days of notification. If a winner does not respond within this timeframe, the Promoter reserves the right to withdraw the prize and select an alternative winner.

Prize Collection or Delivery

Prizes must be collected from, or delivery arranged with, the Promoter within 14 days of confirmation, unless otherwise agreed.

The Promoter accepts no responsibility for prizes that are not claimed or collected within this period.

Use of Entries and Promotional Activity

By entering a competition, entrants acknowledge and agree that their social media username, profile image, and any submitted content may be published on the Promoter’s social media channels and may be visible to the public.

All entries and submitted materials may be used by the Promoter for promotional, marketing, publicity, and PR purposes across digital, social, and in-centre channels, without additional compensation.

Winners may be required to participate in reasonable promotional activity related to the competition.

All entries and submitted materials become the sole property of the Promoter.

Content Moderation and Conduct

The Promoter does not accept responsibility for content posted by entrants on competition posts.

Any content deemed abusive, offensive, unlawful, misleading, or otherwise inappropriate may be removed at the Promoter’s discretion, and entries containing such content may be disqualified.

False or misleading entries will render an entry ineligible.

Data Protection

Personal data provided will be used solely for the administration of competitions and associated promotional activity, in accordance with UK data protection legislation.

Data will not be shared with third parties except where required to administer the competition or fulfil a prize.

Platform Disclaimer

Competitions are in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, or any other social media platform. By entering, participants release all such platforms from any responsibility.

General

The Promoter’s decision in all matters relating to competitions is final and no correspondence will be entered into.

These Terms and Conditions, and all competitions run under them, are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.

User Generated Content (UGC) Addendum

Photo and Video Competitions

This section applies where a competition requires entrants to submit original photographs, videos, audio, written content, or other creative material (“UGC”).

Originality and Rights

By entering a UGC competition, entrants confirm that all submitted content is their own original work and that they own all necessary rights to the content.

Entrants must ensure that any individuals featured in submitted content have given their permission to appear and for the content to be used in accordance with these Terms and Conditions. Where content includes individuals under the age of 18, entrants confirm that parental or guardian consent has been obtained.

UGC must not infringe the intellectual property, privacy, or other rights of any third party.

Content Standards

Submitted content must not contain material that is offensive, defamatory, discriminatory, misleading, unlawful, or otherwise inappropriate.

The Promoter reserves the right to reject, remove, or disqualify any entry that breaches these standards or these Terms and Conditions.

Licence and Use of UGC

By submitting UGC, entrants grant the Promoter a perpetual, royalty-free, non-exclusive, worldwide licence to use, reproduce, edit, adapt, publish, display, distribute, and create derivative works from the content for promotional, marketing, publicity, PR, and in-centre purposes, across all media formats, now known or developed in the future.

This includes the right to crop, edit, overlay graphics or text, and adapt content for different platforms without further approval.

Credit

Where reasonably practicable, the Promoter may credit entrants using their social media handle or name. Failure to provide credit shall not constitute a breach of these Terms and Conditions.

Moral Rights

To the extent permitted by law, entrants waive any moral rights in their submitted content, including the right to object to derogatory treatment of the content.

Third-Party Platforms

UGC submitted via social media platforms may also be subject to the terms and conditions of those platforms.

Liability

The Promoter accepts no responsibility for any claims, losses, or damages arising from the use of UGC submitted by entrants, except where liability cannot be excluded by law.

Removal

The Promoter may remove submitted content from its channels at its discretion. Requests for removal will be considered but cannot be guaranteed where content has already been distributed or republished.
